Collections

The firm represents financial institutions and other creditors in legal actions to collect money and recover collateral in Florida and Georgia. The collections practices area services are structured to provide cost-effective but aggressive legal collection services. We have experience handling both consumer and commercial debts. The typical legal services include the following: replevin actions to recover personal property that serves as collateral for a loan; garnishment actions to collect on a final judgment; levies of personal and real property to collect on a final judgment; and commercial and residential evictions.

Bankruptcy

The firm represents financial institutions and other creditors in Chapters 7, 11, 12 and 13 bankruptcies pending before the U.S. Bankruptcy Courts in Florida and Georgia. Our attorney’s regularly appear before all the bankruptcy courts in Florida and Georgia. The firm’s bankruptcy practice includes both consumer and commercial bankruptcy matters. We not only provide cost effective legal services such as filing proofs of claim and preparing and negotiating reaffirmation agreements, but also have the skill and expertise to handle objections to discharge, objections to confirmation, defending violation of automatic stay actions, representing Creditors in “Show Cause” actions, and other adversarial matters.

Foreclosure

Sorenson Van Leuven has the expertise and skill to handle residential and commercial foreclosures throughout Florida and Georgia. In addition, our foreclosure team can advise and assist on foreclosure alternatives, such as deeds in lieu, short sales, modification and forbearance agreements. Upon completion of the foreclosure, our attorneys can pursue the deficiency balance, obtaining a judgment and then pursue post-judgment remedies. We are also knowledgeable regarding the CFPB regulations regarding loss mitigation and regularly advise clients on compliance with these issues.

Litigation

Sorenson Van Leuven has experienced litigation attorneys who represent our clients in litigation to resolve business and commercial disputes. We have the skills and experience to handle the litigation in an efficient but aggressive manner, making sure our client’s interest are protected. The types of litigation includes the following: contractual disputes with vendors; defense of forfeiture proceedings, defense of suits seeking damages under a consumer protection statutes; and suits with insurance providers regarding coverage disputes. Our attorneys have handled investigations into fraudulent schemes and then pursued litigation involving those schemes to recover money.
Examples include check-kiting, employee embezzlement and/or dishonesty, fraud by third party vendors and related civil matters.

Consulting and Training

Sorenson Van Leuven has developed an expertise in consulting with financial institution clients in matters related to loss mitigation, collections and recovery. Jim Sorenson and Tyler Van Leuven understand industry best practices, legal compliance and effective techniques. Aside from conducting its annual Credit Union Collections and Bankruptcy Conference each year, the firm provides onsite training, consultation, and on-site audit and assessment of a financial institution’s collections/recovery department. With the risk of class action lawsuits, pressure from the Consumer Financial Protection Bureau and changes in consumer mentality, collection departments have tough jobs.
